GREEN BAY, Wis. (WFRV)-- The suspect involved in the early Sunday morning accident that left a 21-year-old Green Bay woman in critical condition has been released from jail.

31-year-old Todd Michael Destree was released from jail Monday, after the district attorney's office decided there was not enough evidence to press charges at this time.

The Brown County District Attorney's office said they are waiting on lab results, the victims hospital records, and other evidence from the scene to determine if charges will be filed.  They said it could be weeks before Destre e would have to appear in court again.

Destree did not have a previous criminal record.

The victim remains in critical condition late Monday afternoon at St. Vincent's hospital.

The investigation continues into the accident continues.  It  happened round 4:20 Sunday morning, police and fire responders were called to South Baird Street where a 21 year-old female was found lying in the street.  She was taken to a local hospital with life-threatening injuries.

Destree was arrested on suspicion of operating a vehicle while intoxicated and causing injury and released Monday. His attorney said no court hearing has been set.
