OSHKOSH (WFRV) - A Fremont man accused of driving a boat while intoxicated and causing a crash that killed a passenger has plead not guilty.
Todd M. Frisbie, 44, entered a not guilty plea during an arraignment headring in Winnebago County Circuit Court Tuesday.
Frisbie faces a charge of Homicide by Intoxicated Use of a Vehicle in connection to a June 6, 2005 boating crash on Lake Butte des Morts that killed 38-year old Alan P. Richards of Holland, Michigan
According to the criminal complaint, Frisbie was intoxicated and driving a 30-foot as he, Richards and a third man were boating home on Lake Butte des Morts from Fratello's bar & restaurant in Oshkosh. The boat crashed in the shallows of Lake Butte des Morts, causing Richards to be ejected from the boat. He was found face-down in the lake by first responders.
If convicted, Frisbie faces up to 40 years in prison and $100,000 in fines. He is due back in court Oct. 5.
